1. Acceptance of Terms

By accessing or using Pitch (“the Service”), operated at gopitch.live, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

Pitch is a live video networking platform that connects crypto founders, investors, and builders through real-time video calls. The Service includes user profile creation, role-based matchmaking, live video and audio communication, screen sharing, friend connections, and optional premium features. The Service is provided on an “as-is” and “as-available” basis.

3. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms. Accounts are registered through Google Authentication, and you are responsible for maintaining the security of your Google account credentials.

4. User Accounts

You are responsible for all activity that occurs under your account. You agree to provide accurate and complete profile information and to keep it updated. You may not create multiple accounts, impersonate another person, or use another person’s account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use Policy

When using the Service, you agree not to:

• Harass, threaten, intimidate, or abuse other users during video calls or through any feature of the Service
• Share sexually explicit, violent, hateful, or otherwise offensive content during video sessions
• Use the Service for any illegal purpose or to solicit others to perform illegal acts
• Spam, scam, or deceive other users, including misrepresenting your identity, role, or intentions
• Record, screenshot, or capture video calls without the explicit consent of all participants
• Attempt to reverse engineer, hack, or interfere with the Service’s infrastructure
• Use automated tools, bots, or scripts to access or interact with the Service
• Share another user’s personal information without their consent
• Promote financial scams, fraudulent tokens, or deceptive investment schemes

Violations may result in immediate suspension or permanent termination of your account at our sole discretion.

6. Video Call Conduct

All video calls on Pitch are live, unrecorded interactions between users. You are expected to conduct yourself professionally and respectfully during every call. Pitch does not monitor or record the content of video calls. However, users may report inappropriate behavior, and we will investigate and take appropriate action, including account suspension or termination.

7. Payments and Subscriptions

Pitch offers optional premium features available through paid subscriptions and one-time purchases. All payments are processed securely through Stripe. By purchasing a subscription, you authorize us to charge your payment method on a recurring basis until you cancel. You may cancel your subscription at any time through the billing management portal. Refunds are handled on a case-by-case basis and are not guaranteed. Prices are subject to change with reasonable notice.

8. Intellectual Property

The Service, including its design, code, features, branding, and content, is the intellectual property of Pitch and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent. You retain ownership of any content you create or share through the Service, but grant us a limited license to use it in connection with providing the Service.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not endorse, verify, or guarantee the accuracy of any information provided by users, including professional credentials, investment capacity, or business claims. You use the Service at your own risk and are solely responsible for evaluating the people you connect with.

10. Limitation of Liability

To the maximum extent permitted by law, Pitch and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, damages for loss of profits, business opportunities, data, or goodwill. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pitch and its operators, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time by contacting us at hello@gopitch.live.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Both parties agree to waive any right to a jury trial or to participate in a class action. The arbitration shall be conducted in English and the decision of the arbitrator shall be final and binding.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
